DMCA Policy

Overview

Asterism respects the intellectual property rights of others and expects users of the Service to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using the Asterism platform.

Reporting Copyright Infringement

If you believe that content available on Asterism infringes your copyright, please send a DMCA takedown notice containing the following information to our designated Copyright Agent:

  1. Identification of the copyrighted work - A description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material - Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed, including the URL or other specific location on the Service where the material appears.
  3. Your contact information - Your name, address, telephone number, and email address.
  4. Good faith statement - A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement - A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Signature - A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.

Counter-Notification

If you believe your content was removed by mistake or misidentification, you may submit a counter-notification containing the following:

  1. Identification of the material - Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed.
  2. Good faith statement - A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Your contact information - Your name, address, telephone number, and email address.
  4. Consent to jurisdiction - A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the United States, any judicial district in which Asterism may be found, and that you will accept service of process from the person who provided the original notification.
  5. Signature - Your physical or electronic signature.

Processing Notices

Upon receiving a valid DMCA notice, we will:

  • Remove or disable access to the allegedly infringing material
  • Notify the content provider that the material has been removed
  • Forward a copy of the notice to the content provider

Upon receiving a valid counter-notification, we will:

  • Promptly provide the complainant with a copy of the counter-notification
  • Inform the complainant that the removed material will be restored in 10-14 business days
  • Restore the material within 10-14 business days unless we receive notice of a court action

Repeat Infringers

In accordance with the DMCA, Asterism has adopted a policy of terminating, in appropriate circumstances, account holders who are deemed to be repeat infringers. We may also limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

You can also report copyright infringement directly through our platform using the "Report" button on any skill page. Select "Copyright / DMCA" as the reason and provide the required information.
