1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Asterism Skills, Inc., a Delaware corporation ("Asterism," "we," "us," or "our"), located at 548 Market St #78234, San Francisco, CA 94104, USA.
By accessing or using Asterism ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Eligibility
To use the Service, you must:
- Be at least 13 years of age (or 16 in the European Economic Area)
- If under 18, have parental or guardian consent to use the Service
- Have the legal capacity to enter into binding agreements
- Not be prohibited from using the Service under applicable laws
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Description of Service
Asterism is a registry platform that allows third-party developers to publish skills for AI coding assistants. Asterism operates as a neutral hosting platform and does not create, author, endorse, or verify the functionality of skills published by users.
4. User Accounts
To use certain features of the Service, you must create an account using GitHub or Google authentication. You are responsible for:
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
5. Third-Party Skills — Important Disclaimers
5.1 Skills Are Third-Party Content
ALL SKILLS AVAILABLE ON THE SERVICE ARE CREATED, PUBLISHED, AND MAINTAINED BY THIRD-PARTY DEVELOPERS, NOT BY Asterism. Ask does not author, review, endorse, guarantee, or assume any responsibility for any skill published on the platform. The presence of a skill on Asterism does not constitute an endorsement of its safety, functionality, or fitness for any purpose.
5.2 Security Scanning Limitations
While Asterism provides automated security scanning, YOU ACKNOWLEDGE AND AGREE THAT:
- Automated scanning CANNOT detect all security vulnerabilities, malicious behavior, or harmful code
- Security scores are indicative only and do not guarantee a skill is safe to use
- Sophisticated attacks including prompt injection, data exfiltration, obfuscated malware, and social engineering may evade detection
- Skills may behave differently at runtime than indicated by static analysis
- New attack vectors may emerge that are not covered by current scanning methods
5.3 Assumption of Risk
BY INSTALLING, LOADING, OR EXECUTING ANY SKILL, YOU ASSUME ALL RISKS ASSOCIATED WITH THAT SKILL, INCLUDING BUT NOT LIMITED TO:
- Data exfiltration or unauthorized access to your files, credentials, or data
- Prompt injection attacks that manipulate AI assistant behavior
- Execution of malicious commands on your system
- Privacy violations or unauthorized data collection
- System damage, data loss, or security breaches
- Financial loss or business disruption
- Any other harm resulting from skill execution
5.4 User Responsibility
You are solely responsible for evaluating and determining the suitability of any skill before use. We strongly recommend:
- Reviewing skill source code before installation
- Understanding declared capabilities and permissions
- Testing skills in isolated environments before production use
- Monitoring skill behavior during execution
- Using skills only from publishers you trust
- Keeping your systems and dependencies updated
6. Publisher Obligations
6.1 Prohibited Content
Publishers may not publish skills that:
- Contain malware, viruses, trojans, or any malicious code
- Perform data exfiltration or unauthorized data collection
- Execute prompt injection or manipulation attacks
- Misrepresent functionality or hide malicious behavior
- Access systems, files, or data beyond declared capabilities
- Violate intellectual property rights or applicable laws
- Harass, threaten, or harm users
- Compromise system security or integrity
6.2 Publisher Indemnification
BY PUBLISHING A SKILL, YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS Asterism, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your skill or any content therein
- Any harm caused by your skill to any user or third party
- Any claim that your skill infringes intellectual property or violates applicable law
- Your breach of these Terms or any applicable law
- Any misrepresentation about your skill's functionality or safety
6.3 Accurate Declarations
Publishers must accurately declare all capabilities and permissions required by their skills. Failure to disclose capabilities or publishing skills that exceed declared permissions is grounds for immediate removal and account termination.
7. Reporting Malicious Skills
If you discover a skill that you believe is malicious, deceptive, or violates these Terms, please report it immediately to security@joinasterism.com. We will investigate and take appropriate action, which may include removing the skill and terminating the publisher's account.
While we endeavor to respond promptly to reports, we make no guarantee regarding response times or outcomes of investigations.
8. API Usage
API access is subject to rate limits based on your subscription tier. You agree not to:
- Circumvent rate limits or usage restrictions
- Use the API to build competing services
- Share API keys or allow unauthorized access
- Use automated means to scrape or harvest data
9. Subscription and Payments
9.1 Subscriptions
Some features require a paid subscription. Payments are processed through Stripe. Subscriptions renew automatically unless cancelled before the renewal date.
9.2 Premium Skills (Marketplace)
When purchasing premium skills from the marketplace:
- You receive a license to use the skill, not ownership of the skill
- Licenses may be perpetual or time-limited as specified at purchase
- Ask acts as a marketplace facilitator; the publisher is the seller
- Ask retains a platform fee as disclosed on the pricing page
9.3 Refunds
Subscription refunds are handled on a case-by-case basis. For premium skill purchases:
- Refund requests within 14 days may be granted if the skill does not function as described
- Refunds are not available for skills that function as described but do not meet your expectations
- Refund requests should be submitted to support@joinasterism.com
9.4 Taxes
Prices may not include applicable taxes. You are responsible for any taxes associated with your purchases, except for taxes based on our income.
10. Intellectual Property
10.1 Our Intellectual Property
The Service, including its design, code, and branding, is owned by Asterism and protected by intellectual property laws. You may not copy, modify, or distribute our intellectual property without permission.
10.2 Your Content
Skills published by users remain their respective owners' property, subject to their chosen licenses. By publishing a skill, you grant ask a non-exclusive, worldwide, royalty-free license to host, display, and distribute your skill as necessary to operate the Service.
10.3 Open Source Licenses
Skills may be published under various open source licenses. You are responsible for complying with the license terms of any skill you use. The license chosen by the publisher governs your rights to use, modify, and redistribute the skill.
10.4 DMCA and Copyright Claims
We respect intellectual property rights and respond to valid DMCA takedown notices. If you believe a skill infringes your copyright, submit a notice to dmca@joinasterism.com with: (1) identification of the copyrighted work, (2) identification of the infringing material, (3) your contact information, (4) a statement of good faith belief, and (5) a statement under penalty of perjury that you are authorized to act on behalf of the copyright owner.

11. Disclaimer of Warranties
THE SERVICE AND ALL SKILLS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND SECURITY.
WE DO NOT WARRANT THAT:
- Any skill is safe, secure, accurate, complete, or reliable
- Skills will function as described or meet your requirements
- Skills are free from malware, vulnerabilities, or harmful code
- Our security scanning will detect all threats, attacks, or malicious behavior
- The Service will be uninterrupted, timely, or error-free
- Any defects or errors will be corrected
YOU EXPRESSLY ACKNOWLEDGE THAT Asterism HAS NO CONTROL OVER THE CONTENT, QUALITY, SAFETY, OR LEGALITY OF SKILLS PUBLISHED BY THIRD PARTIES.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
Asterism SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of data, revenue, profits, or business opportunities
- System damage or security breaches
- Unauthorized access to or alteration of your data
- Data exfiltration or privacy violations
- Business interruption or downtime
- Cost of substitute goods or services
- Any harm caused by third-party skills
THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF Asterism HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL Asterism'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO Asterism IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATIONS OF LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
13. User Indemnification
You agree to indemnify, defend, and hold harmless Asterism and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses arising from:
- Your use of any skill or the Service
- Your violation of these Terms
- Your violation of any applicable law or third-party rights
- Any content you submit or publish
14. Platform Safe Harbor
Ask operates as an interactive computer service and hosting platform for third-party content. To the extent applicable, Asterism claims protection under Section 230 of the Communications Decency Act (47 U.S.C. § 230) and similar laws in other jurisdictions. Ask is not the publisher or speaker of any skill content created by third-party users.
15. Termination and Removal
We reserve the right to remove any skill and suspend or terminate any account at any time, with or without notice, for any reason, including but not limited to violation of these Terms or suspected malicious activity. Upon termination, your right to use the Service immediately ceases.
16. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the modified Terms. If you do not agree to modified Terms, you must stop using the Service.
17. Dispute Resolution
Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware, United States. You waive any right to participate in a class action lawsuit or class-wide arbitration.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
19. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
20. Export Compliance
You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce and sanctions programs administered by the U.S. Department of the Treasury's Office of Foreign Assets Control. You represent that you are not located in, or a resident of, any country subject to U.S. trade sanctions, and are not on any U.S. government list of prohibited or restricted parties.
21. Force Majeure
We will not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, government actions, internet or power outages, or third-party service failures.
22. Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section is void.
23. Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative.
24. No Third-Party Beneficiaries
These Terms are for the benefit of you and Asterism only. There are no third-party beneficiaries to these Terms, and nothing herein is intended to confer any right or remedy on any third party.
25. Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Asterism regarding the Service and supersede all prior agreements and understandings.
